    To sell our land with or without the water rights?

    Hello,

    my husband and I are selling some acerage of land under 100 acres. We have a water right that comes with the land.

    We approached a local estate agent who listed it for us to sell as a whole package (ie the land and water together). We had a few people look at it and one person was very interested in just the land only. The estate agent got back to us and put the offer to us.

    If we decide to sell it this way, we will be paying 2 lots of commission, one for the land to the estate agent and one to the water sellers. Also we wont be selling it for the price that we had asked for if selling it as one whole. We would be getting approx $14,000 less as the price of water fluctuates all the time.

    As we had first decided to sell it together we signed the right to sell forms from the estate agent with the commission that we would be paying. Now that things have changed and we will probably be selling it seperately, can we ask the real estate agent for a reduced commission fee, or negotiate the commission price at all?

    How much is the commission on the sale of the water?  If the value of the water were to be added to the value of the property sold, would the commission payable to the estate agent be the same as the two separate commissions combined?
