Invalidly Appointed Real Estate Agent Keeps Commission on Unsettled Sale

We at Mitchells are very unhappy when one of our clients loses a court case. This is especially so when we believe the decision was wrong and an injustice was done to our client. Most folk who don’t achieve a nevertheless well-deserved win in such circumstances rarely have the funds or the will to appeal to have their wrong righted.

This was the situation with an elderly widow client of our David Graham who presented an extremely comprehensive but unsuccessful claim for compensation for her to the Queensland Civil and Administrative Tribunal. We were very disappointed for her, and obviously annoyed that a licensed real estate agent consequently got to keep his full commission on a sale which had not settled and where he had not been properly appointed by this lady and her late husband. Needless to say Queensland’s Office of Fair Trading apparently took no disciplinary action against this agent in respect of the many breaches of the law which David alleged in his material first presented to that office.
